The Ministry of Health is planning changes in the prescription of preparations containing narcotic drugs, psychotropic substances or category I precursors.
The aim of the changes is to introduce solutions that make it impossible to prescribe medicinal products via paid online platforms without prior examination of the patient. The changes are also intended to increase patient safety and obtaining specific drugs for intoxication purposes.

The draft regulation assumes that prescriptions for preparations containing narcotic drugs, psychotropic substances or category 1 precursors are issued only in electronic form.
A prescription for a preparation containing a narcotic drug of groups IN or II-N, a psychotropic substance of groups II-P, III-P or IV-P, or a category 1 precursor may be issued subject to a personal examination of the patient for whom the prescription is to be issued or examining it via telemedicine solutions (but only if the last in-person examination of the patient to whom such a prescription was issued was carried out within the last year).
*this also applies to non-fibrous hemp preparations and extracts, pharmaceutical tinctures, as well as all other non-fibrous hemp extracts
The obligation to undergo an examination will not apply to situations in which issuing such a prescription is justified by the patient's condition reflected in the medical documentation.
Additionally, the person issuing the prescription will have to verify via the E-zdrowie system the amount and type of medicines prescribed to the patient containing a narcotic drug of groups IN or II-N, a psychotropic substance of groups II-P, III-P or IV-P, or a precursor of category 1, provided that in terms of safety and the need for their use, taking into account the prescriptions issued and filled for this patient.
This requirement will not apply to patients who have not activated IKP.
Prescribing another preparation
Issuing a prescription if it is found that another preparation containing a narcotic drug from groups IN or II-N, a psychotropic substance from groups IIP, III-P or IV-P, or a category 1 precursor has been previously prescribed to the patient to whom the prescription relates, may take place during the period of use this preparation, provided that the doctor or dentist determines the need to issue this prescription justified by the patient's health condition.
Entry in medical records
The regulation also includes the obligation to enter in medical records:
- fact of patient verification on the E-zdrowie portal and personal examination of the patient (if applicable)
- a description justifying the need to issue a prescription justified by the patient's health condition.
